ORDER
BOWEN, District Judge.
In accordance with the previous order of this Court, Mimbs v. Commercial Life Ins. Co., 818 F.Supp. 1556 (S.D.Ga.1993), Plaintiff Elvis Mimbs filed an Amended Complaint against Defendant Commercial Life Insurance Company (Commercial Life). Commercial Life filed an Answer to the Amended Complaint, 1 followed by a motion to dismiss, and, in the alternative, for summary judgment. For the reasons stated below, the motion is treated as one for summary judgment, and summary judgment for Commercial Life is granted in part and denied in part.
