This action arises out of a Master State and Municipal Lease/Purchase Agreement (the “Master Lease Agreement” or “MLA”) under which the City of Burlington (“Burlington” or “the City”) secured funds for the lease-to-purchase of telecommunications equipment (the “Equipment”) and for the construction and operation of a city-wide fiber optic network.
