The petition was filed February 20th, 1875, and contained two counts. The first alleged that prior to the 4th day of March, 1874, the defendant had erected and on said day maintained in the Missouri River near the southern bank thereof at Kansas City, a certain lumber and timber structure; and nearer the center of the river at that point another structure, box-like in form and filled with stone, rising to a height of thirty feet or more above the surface of the river, both of which were obstacles in the way of vessels and rendered navigation dangerous; that said structures were erected and…
