WRIGHT, District Judge.
This matter is before the court on motion for temporary injunction. The case arises out of a contract between the parties in which the defendant, for a sum stated which the plaintiff agreed to pay, obligated himself to build for plaintiff one steel tugboat. The contract price was $95,000, including a down payment of $20,006 which the plaintiff promptly made. At the present time, the vessel is still under construction, but the hull thereof, with certain attachments thereto, is actually in being.
