On the 24th day of October, 1911, the plaintiff filed his petition in the district court of Polk county, claiming, among other things, that the defendant is a mutual benefit association incorporated under the laws of this state; that on the 9th day of July, 1910, the plaintiff made an application for membership' in said association at its home office; that he paid a membership fee of $4 as required by the association; that on the 16th day of July, 1910, his application was accepted, and the plaintiff received in said association as a member thereof, and was such member at the time of the…
