This is a certified question from the Court of Civil Appeals of the Third District. The statement and question are as follows:

“This is a suit to recover damages for decrease in the market value of certain town lots. The plaintiff recovered a judgment and the defendant has appealed.

“The plaintiff’s suit is predicated upon the allegations in his petition to the effect that he is the owner of the lots in controversy, located in what is known as the ‘Katy’ addition to the town of San Marcos; said lots being situated just across a street and near by defendant’s right of…
