I cannot concur in the opinion of Mr. Justice Potter.

In October, 1933, the department approved a settlement agreement between the parties and granted plaintiff’s petition for a lump sum settlement thereunder, stating: “after■ due investigation and consideration of said petition and inquiry into the facts and circumstances of the case.”

In January, 1934, upon plaintiff’s petition for further compensation, the department found that, at the time of the approval of the lump sum settlement, plaintiff was totally disabled and should be permitted to collect compensation for total disability, and the…
