Fear v. United States Trustee (In Re Ruiz)
United States Bankruptcy Appellate Panel for the Ninth Circuit
1Opinion of the Court
OPINION
DUNN, Bankruptcy Judge:
Chapter 72 trustee Peter L. Fear (“Trustee”) applied to the bankruptcy court for compensation and payment of expenses. Although the application was unopposed, the bankruptcy court awarded the Trustee only a portion of the requested compensation, reasoning that the requested amount, which exceeded the amount available for distribution on allowed unsecured claims, was too high. The Trustee appeals. We VACATE the order of the bankruptcy court and REMAND the matter for further proceedings.
