GLADIS, Senior Judge:

This case comes before us on appeal by the government pursuant to Article 62, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 862, and Rule for Court Martial (R.C.M.) 908, Manual for Courts-Martial, 1984 (MCM). At the initial Article 39(a), 10 U.S.C. § 839(a) session, the military judge granted appellee’s motion for appropriate relief requesting exclusion of two incidents of uncharged misconduct occurring prior to and subsequent to the incident from which the charges are drawn.
