This is a companion case to Yankee Network, Inc., v. Federal Communications Commission, recently decided by this court. It arose out of the same proceeding before the Commission, and was argued and submitted on the same record. J. T. Ward, appellant in the present case, is the owner of Station WLAC, located at Nashville, Tennessee, which is licensed by the Commission to operate on kilocycle frequency 1470, with 5 kilowatts power day and night.
