This was ejectment to recover real estate in the city of Minneapolis. Both parties claim under a mortgage executed June 6, 1857, by William Clendcnin to Harvey Vinal, to secure two notes, one for $216, due in six months, and one for $1,416, due in one year. On August 31, 1858, Vinal assigned the notes to this plaintiff, and executed and delivered to him an assignment of the mortgage, with a blank space for the name of the assignee.
