At the trial this case resulted in a verdict by the jury in favor of the plaintiffs, whereupon defendant filed a motion for new trial and motion for ju'dgment n. o. v. We dismiss the motion for a new trial *476inasmuch as we believe the matter is properly disposed of on the motion for judgment n. o. v.

The facts are as follows:
