The Circuit Court of the City of Virginia Beach convicted Geoffrey Narcisco Rivera of possession of marijuana with the intent to distribute in violation of Code § 18.2-248.1 and conspiracy to distribute marijuana in violation of Code §§ 18.2-256 and 18.2-248.1. On appeal, Rivera contends that the circuit court erred by denying his motion to suppress evidence obtained from the warrantless search of his cell phone and incriminating statements that he made following the search.
