The indictment in this case was for murder in the first degree. On the trial the defendant was convicted of murder in the second degree and given a sentence of twenty years in the penitentiary.

The testimony tends to prove that the defendant (appellant here) and the deceased were husband and wife, and had been for some fifteen years. They separated on the night of June 13, 1938; the wife leaving the domicile, at the command of the husband, going to the home of her parents, who lived in the same town; she did not return to the domicile until about 3 o'clock P.
