1Per curiam
The plaintiff in error, Tom Taylor, was on the 12th day of October, 1938, indicted by a grand jury of Brevard County, Florida, for the murder of one James Wilson in said county on the 1st day of June, 1938. Pie was arraigned on said indictment and entered a plea of not guilty, and placed upon trial and was by a jury of Brevard County convicted of murder in the second degree and by the trial court sentenced to the State penitentiary at hard labor for a period of twenty years.
