This action was instituted by the defendant in error against the plaintiff in error, and, for convenience, the parties will be herein designated as they appeared in the court below.

Plaintiff alleges in his petition the defendant, Sam Sparks, willfully, maliciously, and without probable cause caused the plaintiff to be arrested, charged with the crime of petit larceny, to wit, with the larceny of oats, the property of defendant, and caused plaintiff to be brought before a justice of the peace, and maliciously and without probable cause, prosecuted the plaintiff upon the…
