MEMORANDUM AND ORDER
HURLEY, District Judge.
Pending before the Court is the motion of plaintiff Philip Aaron (“plaintiff’) for summary judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the reasons set forth below, the motion is denied.
I. BACKGROUND
Plaintiff commenced this action to enforce and recover upon a promissory note. (Compilé 5-7.) The promissory note, which was executed on June 24, 1996, obligates defendant to repay $66,000 with in terest at 7.75% per annum to Philip Irwin Aaron, P.C., plaintiffs predecessor in interest.
