Plaintiff Alba Somoza (“Somoza”) brought this case against defendant New York City Department of Education (the “DOE”) alleging that she was denied a free appropriate public education, to which she is entitled under the Individuals with Disabilities Education Act, 20 U.S.C. § 1400 et seq. (the “IDEA” or the “Act”), and Article 89 of the New York State Education Law.
