Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Department of Motor Vehicles which found petitioner guilty of failing to obey a traffic control device.

Following the issuance of a summons charging him with failure to obey a traffic control device in violation of Vehicle and Traffic Law § 1110 (a), petitioner entered a plea of not guilty.
