Appeal from a judgment of the County Court of Otsego County (Mogavero, Jr., J.), rendered January 25, 1982, upon a verdict convicting defendant of the crimes of attempted arson in the third degree and burglary in the third degree.

As a result of a fire which occurred on June 26, 1980 in the Town of New Lisbon, Otsego County, defendant was indicted and charged with arson in the third degree, a class C felony, and burglary in the third degree, a class D felony.
