Appeal from a judgment of the Supreme Court (Sheridan, J.), rendered April 22, 1999 in Rensselaer County, upon a verdict convicting defendant of the crimes of criminal possession of a controlled substance in the fourth degree and resisting arrest.

Defendant was indicted for criminal possession of a controlled substance in the fourth degree and resisting arrest. The crimes stemmed from an incident which occurred during the early morning hours of August 2, 1998 in the City of Troy, Rensselaer County.
