Carolyn Baker brings suit against Tom-kins Industries, Inc. (“Tomkins”) and Ruskin Health Care Plan (“the Plan”), alleging that they violated 29 U.S.C. § 1133 of the Employee Retirement Security Act of 1974 (“ERISA”), based on their denial of health insurance benefits for a cochlear implant. This matter comes before the Court on Defendants Tomkins Industries, Inc.
