This was’ an action to recover on a promissory note. Various defenses were pleaded. The cause was tried by the court without a jury, and judgment was entered in favor of defendant.

The material facts were these: For some time prior to February 23,1918, N. B. Friesen, H. N. Friesen and H. H. Wall were partners in the implement business in Fairbury, Jefferson county, Nebraska.
