Graves, J:

Willey and his son-in-law, one Warner, made their joint and several promissory note to Snyder for two thousand dollars, and payment being refused when it matured, Snyder-brought this suit against Willey upon it. Willey defended, and the' essence of his defense was, that a material part of the consideration was the stifling of two criminal prosecutions (of which one was for forgery), commenced at Snyder’s instance, and then pending against Warner.
