OPINION AND ORDER

CAFFREY, District Judge.

This matter came before the Court on petitioner’s application for a writ of habeas corpus, respondents’ opposition to the granting of the writ, and respondents’ motion to dismiss the application. A hearing was held, at which testimony of Rabbi Roland B. Gittelsohn was offered by petitioner for the purpose of showing compatibility between the principles of Jewish theology and the principles of conscientious objection, and for showing that there is a basis in Jewish theology for conscientious objection.
