Tbis action was commenced in February, 1932, for tbe purpose of having tbe assets of the Spokane Savings Bank (hereinafter called the bank) impressed with a trust to the extent of the contingent fund and undivided profits of the Spokane Savings and Loan Society (hereinafter called the society) which were transferred to the bank on October 11, 1929, and to have the amount pro rated to the plaintiffs, and to all others similarly situated who were shareholders in the society at the time of the tranfer.
