OPINION AND ORDER DENYING PETITION FOR WRIT OF HABEAS CORPUS

MELTON, District Judge.

This cause came before the Court on a petition for writ of habeas corpus, filed on December 1, 1982, by CARL RAY SONGER, a death-row inmate at Florida State Prison. Respondents filed their response to the petition on December 21, 1982, and an evidentiary hearing on this matter was conducted on February 10,1988.
