Plaintiff has instituted two actions for specific performance to compel the defendant to surrender the premises located at 24 and 26 West Forty-ninth street, New York, the lease of which expired on June 30, 1928. The complaint also seeks a declaration of the rights of the plaintiff in the premises. The present motions are made by defendant for judgment on the pleadings. The causes of action are founded on twenty-one-year leases made between the plaintiff and the defendant’s predecessor on July 1, 1907.
