The plaintiff in error, T. W. Burrows, prayed an appeal from the judgment of the Circuit Court and filed an appeal bond in apt time, but, for some reason, has abandoned his appeal and has sued out a writ of error to reverse the order of the court of February 18th, and assigns error and contends that the court erred in refusing to quash the execution and in sustaining the cross motion of defendant in error, “to vacate order setting aside default as to T.
