Appeal from the Circuit Court of Montgomery county; the Hon. Jesse J. Phillips, Judge, presiding. This was a bill filed in the circuit court of Montgomery county, by appellees, Mary E. McCambridge, Blair McCam-bridge and Jeremiah Sullivan, against appellant, Hobson, to set aside a levy, sale, certificate of purchase and sheriff’s deed to an eighty-acre tract of land, and to restrain Hobson from further prosecuting an action of ejectment therefor.

The bill in this case sought to set aside the sheriff’s sale and deed of the eighty-acre tract of land in question, and the circuit court rendered its decree in accordance with the prayer of the bill. It is insisted there was no authority of law for filing the transcript of the judgment of the justice of the peace in the office of the- clerk of the circuit court, and therefore no execution could properly be issued thereon by the clerk of said court.
