MORRIS, Judge.

This is an action for damages resulting from personal injuries received by the plaintiff and respondent George Fisher while riding as a passenger in an automobile owned and driven by one Ben Knoepfle which collided with an automobile driven by Reinhold Suko whose executor is the defendant. Suko received fatal injuries. The collision occurred at about 3:00 o’clock p. m. on a clear day on U. S. Highway No. 10 just east of the City of Medina on a lazy S curve.
