LESLIE, Chief Justice.

This is an appeal from the judgment of the District Court based on the jury’s answers to special issues that plaintiff, Tilli-son, take nothing by reason of his suit against the defendant, O. I. Griffin, for damages arising from injuries to the plaintiff’s minor daughter, that caused her death, which plaintiff alleged was the proximate result of the negligence of the defendant. The suit was predicated on the theory of attractive , nuisance maintained by the defendant. Plaintiff appeals and the parties will be referred to as in the trial court.
