This suit was brought by the appellees, L. F. Niekey and his wife, L. M. Niekey, against E. F. Connell, appellant, W. I-I. Russell, and Roy -F. Barber, in which they sought to set aside and enjoin other proceedings under a certain default judgment rendered in the district court of Deaf Smith county in favor of the appellant, E. F. Con-nell, and against L. F. Niekey and L. M. Niekey, on November 25, 1912. This case .was tried in the court below, without a jury. The court rendered a judgment therein, vacating ■ and setting aside the default judgment, and perpetually enjoining any further…
