*740 Curtis R. Holmes appeals from the trial court's order granting David G. Sheppard and Farm Bureau Insurance of North Carolina, *373 Inc.'s ("Farm Bureau") (collectively "Defendants") motion for summary judgment as to Holmes's causes of action for: (1) negligence and (2) negligent misrepresentation. On appeal, Holmes argues that the grounds argued *741 for granting the motion are either precluded by precedent, disputed by issues of material fact, or both.
