OPINION

GODDARD, Judge.

This case involves the interpretation of T.R.C.P. Rule 3 in conjunction with claims against an uninsured motorist carrier pursuant to T.C.A. § 56-7-1206.

On February 1, 1985, Defendants Kreg-ger and Spurling were involved in an automobile accident with the Plaintiffs. The Plaintiffs filed suit for their injuries against Kregger and Spurling on July 15, 1985. Process was returned unserved on November 17,1985.
