MEMORANDUM AND ORDER
SKINNER, District Judge.
The plaintiff in this case (“Red Star”) seeks damages and injunctive relief as the result of a work stoppage by the defendant (“Local 170”). It also seeks to vacate part of an arbitrator’s award to one of its employees. Both parties have moved for summary judgment.
On the morning of May 4, 1983, a Red Star employee named Allen Bishop (“Bishop”) suffered serious injuries in an accident which occurred while he was driving a Red Star truck in New York. On May 27, 1983, Red Star discharged Bishop for driving recklessly and causing the May 4 accident.…
