Defendant was convicted after a trial before a jury of a violation of section 288a of the Penal Code. He appeals from the judgment and from the order denying his motion for new trial.

Kenneth Peel, the prosecuting witness, a boy of the age of 15, lived in Romoland, California, and was a student at the Perris Senior High School. He attended a dance in Riverside on the evening of October 20, 1947, and on his way home stopped at the Bright Spot Café in Perris shortly after midnight.
