FINDINGS OF FACT, DISCUSSION AND CONCLUSIONS OF LAW

GORBEY, District Judge.

This is an action for patent infringement brought pursuant to 28 U.S.C. § 1338, seeking an injunction against further infringement and seeking damages for the past infringement. Plaintiff is the assignee of Patent No. 3,002,240, granted October 3, 1961, to Máxime Laguerre, plaintiff’s assignor. The device is called a closure device and is used in sealing plastic bags.
