MEMORANDUM OPINION AND ORDER
MAROVICH, District Judge.
Plaintiffs Great Lakes Higher Education Corporation (“Great Lakes”) and First Wisconsin National Bank of Milwaukee (“First Wisconsin”) filed a five count complaint against Defendant Austin Bank of Chicago (“Austin”) alleging breach of warranty (810 ILCS 5/4-207), negligence in the presentment of certain checks (810 ILCS 5/4r-202), breach of warranty to a third party beneficiary (810 ILCS 5/4-207), conversion (810 ILCS 5/3-420) and common law negligence.
