I. INTRODUCTION

The plaintiff, Mount Vernon Fire Insurance Company (“Mount Vernon”), seeks declarations that it is not required to handle or pay a certain insurance claim. The remaining parties to this action have agreed to have the motion for summary judgment presently before this Court converted into a case stated.
