Clyde Pitts was convicted of rape, and appeals. The principal question involved is whether the court erred in admitting evidence of the victim’s statements that defendant was her assailant.

Agnes Crowley was a telephone operator at the Rosedale exchange. On the night of March 30, 1927, while she was walking home after her day’s work, she was seized from behind, carried to a vacant lot, and was ravished.
