Appellant has contested the payment of a tax for lighting imposed under the Act of July 14, 1917, P. L. 840, as amended by the Act of April 27, 1927, P. L. 464. His opposition in the court below and on this appeal is on the ground that clause 2, §386, ch. 7, art. 2, of the Act of July 14, 1917, P. L. 840, as amended by the Act of April 27, 1927, P. L. 464, §1, 1 is uncon stitutional in that it violates sections 1 and 2, art. 9, of the Pennsylvania Constitution and the Fourteenth Amendment of the Federal Constitution.
