THIS MATTER is before the Court on four motions by the defendants. The first is a motion to dismiss the Amended Complaint under Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure by the defendants Virginia Commonwealth University (“VCU”) and VCU President Eugene Trani, in both his individual and official capacities (collectively, “University Defendants”).
