The complaint in this action alleged that the defendants were engaged in the business of operating a retail fuel yard in the county of King, state of Washington, and that, in December, 1921, the department of labor and industries, through and by means of the division of industrial insurance, acting by virtue of ch. 182, p. 719, of the Laws of 1921, after a hearing duly had, made a decision and an order that the business of operating a retail coal yard is in fact extra-hazardous, and therefore came within the provisions of the state workmen’s compensation act, and that such decision and order…
