INTRODUCTION

Plaintiff, Andrew J. Sipas, (“Plaintiff’ or “Sipas”) brings this claim against defendants William Szafarowicz and Cynthia R. Dahlke (“Szafarowicz” or the “Defendants”), claiming that they are committing trespass on land which Sipas is the owner of record. The Defendants have denied the allegation of trespass, asserting by counterclaim that they have acquired ownership by adverse possession. Both parties seek declaratory judgment on this issue.
