PARKER, Circuit Judge.

This was an action at law instituted in the court below to recover on a negotiable certificate of deposit issued by the defendant bank. The International Finance Corporation was plaintiff there, and the People’s Bank of Keyser, W. Va., was defendant. They will be so designated in this opinion. A plea of non est factum was entered, and as a special ground of defense it was alleged that the certificate was signed by defendant’s cashier without authority.
