OPINION AND ORDER DENYING PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT
WALTER J. KRASNIEWSKI, Bankruptcy Judge.
This matter is before the court upon plaintiff’s motion for summary judgment and defendant Frederick L. Hotchkiss’ memorandum in opposition thereto. Upon consideration thereof, the court finds that plaintiff’s motion is not well taken and should be denied.
