— In a medical malpractice action to recover damages for personal injuries, etc., the defendant appeals from so much of an order of the Supreme Court, Kings County (Clemente, J.), dated July 18, 1985, as denied that branch of its motion which was for summary judgment dismissing the personal injury cause of action and the plaintiff cross-appeals from so much of the same order as (1) granted that branch of the defendant’s motion which was for leave to amend its answer to assert the Statute of Limitations as a bar to the derivative claim, and (2) denied his cross motion for further discovery.
