KRUEGER, Judge.

The conviction is for an assault with intent to murder without malice. The punishment assessed is confinement in the state penitentiary for a term of one year.

The evidence adduced by the State, briefly stated, shows that on the evening of the 23rd of April, 1944, Travis Edgar, the injured party, Elbert P. Elmore, and Donald R. Endresen, being soldiers stationed at Camp Wolters, came to the town of Mineral Wells.
