HUNTER, Justice.

This case is before this Court upon the petition to transfer of defendant-appellant, Indiana Insurance Company (Indiana). Ap-pellee James Gilson, a general contractor, was sued for damages allegedly caused by faulty construction on a house he had built for Louis and Joanna DeZutti. Gilson called upon Indiana to provide his defense pursuant to the terms of a comprehensive general liability policy he owned. Indiana maintained that the alleged loss was not covered by the policy.
